1. OBJECT

These general conditions of sale aim to define the rights and obligations of La Toile and the Customer of products presented by La Toile on its site www.latoile.art (hereinafter “the Site”). They apply exclusively between the company La Toile, 62 Boulevard Périer, 13008 Marseille, Siret: 95355121500015 (hereinafter “La Toile”) and unique identifier number: FR79953551215 and any individual consumer visiting or making a purchase via said Site (hereinafter “the Client”).

On the Site, La Toile allows the Customer to order La Toile brand products online (hereinafter “the Product(s)”) according to these general conditions.

Any order placed with La Toile therefore entails unreserved acceptance by the Customer of these conditions. These general conditions may be modified at any time and without notice by La Toile, the applicable conditions being those in force on the date of the order by the Customer.

2.CUSTOMER OBLIGATIONS

2.1. The Customer declares to be at least 18 years old and to have the legal capacity or to hold parental authorization allowing him to place an order on the Site.

2.3. Once the order has been placed, La Toile sends the Customer an e-mail confirming it. He informs him of the shipment of the Products.

2.4. The Customer can modify his data in the “my account” section.

3.ORDER

3.1. Any order will only be validated after payment has been accepted.

3.2. La Toile reserves the right to cancel or refuse an order in the event of a dispute with the Customer regarding a previous order.

3.3. La Toile can accept orders while stocks last. It informs the Customer of the availability of the Products sold on the Site at the time of confirmation of the order.

If, despite La Toile's vigilance, the products are unavailable, La Toile will inform the Customer by e-mail as soon as possible. The Customer may then cancel his order and be reimbursed, if applicable, the amounts already paid.

Permanent or temporary unavailability cannot in any way engage the liability of La Toile, nor can it give rise to any right to compensation or damages in favor of the Customer.

4.PRICE

4.1. The prices displayed on the Site are indicated in euros, all French taxes included (French VAT and other taxes that may apply), excluding shipping costs, participation in order processing costs and packaging costs.

Shipping costs, participation in order processing costs and packaging costs will be indicated in the Customer's basket, before final validation of the order. Prices may be modified at any time, without notice and in particular in the event of a change. fiscal or economic data.

Items will be invoiced based on the rates in effect at the time the order is placed.

5. DELIVERY

5.1. La Toile delivers its Products in France and in all countries of the European Union and can, on request, deliver to any country.

The products are shipped to the delivery address indicated by the Customer when ordering. Delivery cannot be made to hotels or post office boxes. The delivery times indicated on the site are indicative times, corresponding to the average processing and delivery times. In order for these deadlines to be respected, the Customer must ensure that they have communicated accurate and complete information concerning the delivery address (such as, in particular: street number, building number, staircase number, access codes , names and/or intercom numbers, etc.).

In the event of a delivery delay of more than 7 working days, if the product has not been shipped, the Customer may cancel the order by registered letter with acknowledgment of receipt and request reimbursement for their order. If the item was shipped before receipt of the cancellation of the order for late delivery of more than 7 days, La Toile will reimburse the item and the shipping and return costs, upon receipt of the item. here, complete, in its original condition and with all labels.

La Toile undertakes to inform the Customer of the progress of the processing of their order.

In the event of damaged packages (already opened, missing products, etc.), the Customer undertakes to notify the carrier and La Toile, by all means, of any reservations within 3 days following receipt of the product.

La Toile cannot be held responsible for the consequences due to a delivery delay not due to its fault.

6. RETURN POLICY

At La Toile, we want our customers to be satisfied with their purchases. If for any reason you are not completely satisfied with your purchase, we are here to help. Please read our returns policy carefully below.

6.1. Right to retract

6.3.1 The costs of returning the Products are the responsibility of the Customer, except in the event of non-conformity or defect of the Products.

6.4. Refund

6.4.1 In the event of withdrawal in accordance with this policy, La Toile undertakes to reimburse the Customer the total amount of the order, including standard delivery costs, within 5 working days of receipt of the Products returned. The refund will be made using the same means of payment as that used by the Customer for the initial transaction, unless expressly agreed by the Customer for a different means.

6.4.2 If the returned Products are damaged or show signs of use, La Toile reserves the right to refuse partial or total reimbursement.

6.5. Destruction of NFTs (only for Products associated with mined NFTs)

6.5.1 If the returned Product is associated with a minted NFT, the Customer must burn the NFT corresponding to this object. Proof of this action must be provided to La Toile before the refund can be made. The Web reserves the right to verify the burning of the NFT before proceeding with the reimbursement.
