Terms and conditions of sale

1.PURPOSE

The present general conditions of sale aim to define the rights and obligations of La Toile and the Customer of products presented by La Toile on its website www.latoile.art  (hereafter "the Site"). They apply exclusively between the company La Toile, 62 Boulevard Périer, 13008 Marseille, Siret: 95355121500015 (hereinafter "La Toile") and unique identification number: FR79953551215 and any individual consumer visiting or making a purchase via the said Site (hereinafter "the Customer").

On the Site, La Toile allows the Customer to order La Toile brand products online (hereinafter "the Product(s)") in accordance with these general terms and conditions.

Any order placed with La Toile therefore implies the Customer's unreserved acceptance of these conditions. The present general conditions may be modified at any time and without prior notice by La Toile, the applicable conditions being those in force at the date of the order by the Customer.

These general terms and conditions of sale are permanently accessible at the following address: Link to the GCS in a format that can be printed and/or downloaded, so that the Customer can reproduce or save them.

2.OBLIGATIONS OF THE CUSTOMER

2.1. The Customer declares that he/she is at least 18 years old and has the legal capacity or parental authorisation to place an order on the Site.

2.2. The Customer undertakes to provide La Toile with the real information necessary to carry out the service which is the subject of these conditions, as requested online and according to his/her situation, in particular his/her surname, first name, address, telephone number and valid e-mail address. The Customer is responsible for the consequences arising from false or inaccurate information transmitted or the use of which would be illicit.

2.3. Once the order has been placed, La Toile will send the Customer an e-mail confirming the order. It will inform the Customer that the Products have been dispatched.

2.4. The Customer can change his details in the "My Account" section.

 

3.CONTROL

3.1 All orders will only be validated once payment has been accepted.

3.2. La Toile reserves the right to cancel or refuse an order in the event of a dispute with the Customer over a previous order.

3.3. La Toile may accept orders within the limits of available stocks. It informs the Customer of the availability of the Products sold on the Site when the order is confirmed.

If, despite the vigilance of La Toile, the products are unavailable, La Toile will inform the Customer by e-mail as soon as possible. The Customer will then be able to cancel the order and be reimbursed for any sums already paid.

 

 

La Toile shall in no way be held liable for any permanent or temporary unavailability, nor shall it give rise to any right to compensation or damages in favour of the Customer.

4.PRICE

4.1. The prices displayed on the Site are indicated in euros, including all French taxes (French VAT and any other taxes that may be applicable), but excluding delivery costs, order processing costs and packaging costs.

Shipping costs, order processing costs and packaging costs will be indicated in the Customer's basket before the order is finally confirmed. Prices may be changed at any time, without prior notice, particularly in the event of changes in tax or economic data.

Items will be invoiced on the basis of the prices in force at the time the order is registered.

 

5.DELIVERY

5.1. La Toile delivers its Products in France and in all the countries of the European Union and can deliver in any country on request.

Products are sent to the delivery address indicated by the Customer when placing the order. Delivery cannot be made to hotels or post office boxes. The delivery times indicated on the site are indicative times, corresponding to the average processing and delivery times. In order for these times to be respected, the Customer must ensure that they have provided accurate and complete information concerning the delivery address (such as, in particular: street number, building number, staircase number, access codes, names and/or intercom numbers, etc.).

In the event of a delay in delivery of more than 7 working days, if the product has not been dispatched, the Customer may cancel the order by registered letter with acknowledgement of receipt and request a refund of the order. If the article has been dispatched before receipt of the cancellation of the order for late delivery of more than 7 days, La Toile will refund the article and the dispatch and return costs on receipt of the article, complete, in its original condition and with all labels.

La Toile undertakes to keep the Customer informed of the progress of his/her order.

In the event of damaged packages (already opened, missing products, etc.), the Customer undertakes to notify the carrier and La Toile, by any means, of any reservations within 3 days of receipt of the product.

La Toile cannot be held responsible for the consequences of a delay in delivery for which it is not responsible.

6. RETURN POLICY

At La Toile, we want our customers to be satisfied with their purchases. If for any reason you are not completely satisfied with your purchase, we are here to help. Please read our returns policy carefully below.

6.1. Right to retract

6.1.1 The Customer has a period of [indicate the number of days, for example 14 days] from receipt of the Products to exercise his right of withdrawal without having to provide reasons or pay penalties, upon receipt of the Products. 'except for return costs.

6.1.2 To exercise his right of withdrawal, the Customer must notify La Toile of his decision to withdraw by means of an unambiguous declaration. 6.2. Return Conditions

6.2.1 Returned Products must be in perfect condition, unused, and in their original packaging, including labels and accessories.

6.2.2 The Customer is responsible for adequately packaging the returned Products to avoid any damage during transport.

6.3. Return fees

6.3.1 The costs of returning the Products are the responsibility of the Customer, except in the event of non-conformity or defect of the Products.

6.4. Refund

6.4.1 In the event of withdrawal in accordance with this policy, La Toile undertakes to reimburse the Customer the total amount of the order, including standard delivery costs, within 5 working days of receipt of the Products returned. The refund will be made using the same means of payment as that used by the Customer for the initial transaction, unless expressly agreed by the Customer for a different means.

6.4.2 If the returned Products are damaged or show signs of use, La Toile reserves the right to refuse partial or total reimbursement.

6.5. Destruction of NFTs (only for Products associated with mined NFTs)

6.5.1 If the returned Product is associated with a minted NFT, the Customer must burn the NFT corresponding to this object. Proof of this action must be provided to La Toile before the refund can be made. The Web reserves the right to verify the burning of the NFT before proceeding with the reimbursement.
